Disability Benefits

SSDI, SSI, and the workers compensation overlap

Summary

Social Security Disability Insurance (SSDI) and Supplemental Security Income (SSI) can replace income when a serious impairment keeps you from substantial work for at least 12 months. Kaplan & Kaplan helps New Jersey claimants — especially injured workers already in the Division system — file, appeal, and coordinate the workers compensation offset. Free consultation. Call (973) 694-8100.

SSDI is an earned benefit based on work credits. SSI is need-based with the same medical standard and different financial rules. Injured workers often meet the medical standard after a serious job accident or occupational disease. The mistake is treating Social Security as a separate universe from workers compensation when the same treating doctors, imaging, and work restrictions prove both claims.

Ken Kaplan, Esq. and the firm already know treating doctors, restrictions, and wage history when we handle the New Jersey workers compensation case. That file is often the backbone of a successful SSDI claim. Most initial applications are denied — reconsideration and an Administrative Law Judge hearing are where many New Jersey claimants finally win, if the record is complete and the vocational story is honest.

This hub links to child guides for SSDI applications, SSI, denied appeals, and the workers compensation offset. Read the page that matches your stage, then call so we can align medical proof across systems instead of letting two adjusters and one SSA examiner tell three different stories about the same back, knee, or traumatic brain injury.

Law Offices of Kaplan & Kaplan, P.C. represents claimants and plaintiffs only from 810 Belmont Avenue, Suite 201, North Haledon, NJ 07508. We do not represent employers or insurers. Disability representation fees for SSDI and SSI are regulated; workers compensation fees are typically court-approved. Consultations are free.

Disability Guides

What Social Security disability services do we handle?

Each card links to a dedicated page — short hub blurbs, full depth on the spoke. Use these when you need process detail beyond this overview.

If you already have an open Division petition, bookmark our workers compensation pillar as well. The medical narrative should be consistent: onset date, work restrictions, failed return-to-work attempts, and why light duty is not sustainable substantial gainful activity under Social Security rules.

Benefits

What is the difference between SSDI and SSI?

SSDI is based on your work credits; Medicare eligibility can follow after a waiting period, and family members may qualify for auxiliary benefits. SSI is needs-based with strict limits on income and resources. Both use a similar medical standard: a qualifying impairment that prevents substantial gainful activity for at least 12 months (or is expected to result in death).

Many New Jersey injured workers apply for SSDI because they have years of covered earnings from manufacturing, healthcare, warehouse, construction, or transportation jobs. SSI may matter when credits are insufficient, when a younger worker has a thin earnings record, or when a disabled adult child or other special category applies. Some people pursue both and SSA sorts entitlement.

Neither program is a workers compensation permanency award by another name. A high permanent partial disability rating helps the medical story, but SSA still asks whether you can perform other work that exists in significant numbers in the national economy. That vocational step is where incomplete function reports and optimistic light-duty notes sink claims.

Process

How does a New Jersey disability claim typically move?

The federal process is sequential. Skipping development at the application stage often means a longer hearing wait with the same thin record.

Timelines vary by office and hearing backlog. Filing promptly preserves the protective filing date and back-benefit window. Keeping treatment current matters because SSA weighs recent evidence heavily. Gaps in care without explanation become arguments that you are not as limited as alleged.

1

Application

We help assemble work history, medical sources, and function reports so SSA is not guessing about your limits, medications, and failed work attempts after the injury or illness.

2

Denial and reconsideration

Most first decisions are denials. Reconsideration is a second look at the same agency level — still worth doing correctly with updated records rather than a rubber-stamp appeal.

3

ALJ hearing

A judge, vocational expert, and your testimony. Preparation here is the difference between a theory and a record that withstands cross-examination about daily activities and transferable skills.

4

Appeals Council or federal court

If the judge is wrong on the law or the evidence, further review may be available. We discuss that path case by case and do not promise outcomes the record cannot support.

Workers Comp

Why does the workers compensation offset matter?

Federal rules can reduce SSDI when workers compensation and certain other public disability benefits push combined payments above a cap tied to your average current earnings. A lump-sum New Jersey workers compensation settlement can be prorated across months or years. Poor wording can cost monthly SSDI dollars long after the Judge of Compensation approves the award.

If you have both a Division case and a Social Security claim, read the offset guide before you sign any Section 20 or Section 22 papers — and keep the workers compensation pillar page bookmarked for the job-injury side of the file. Settlement language that ignores Social Security is one of the most expensive quiet mistakes injured workers make.

Kaplan & Kaplan coordinates these systems because we already handle the New Jersey workers compensation petition. One firm can align medical proof, work restrictions, and settlement structure instead of leaving you to reconcile conflicting advice from two strangers who never read each other's files.

Evidence

What medical evidence does SSA actually use?

SSA builds a residual functional capacity (RFC) assessment from treating notes, imaging, specialist opinions, consultative exams, and your own function reports. Objective findings help, but function matters: sitting, standing, lifting, reaching, attendance, and need for unscheduled breaks. A diagnosis alone rarely wins a hearing.

Injured workers often have rich Division files — authorized treating reports, IME opinions, and permanency evaluations. Those documents are useful, yet they are written for New Jersey workers compensation standards, not SSA listings. We translate restrictions into RFC language and obtain clarifying opinions when treating doctors will support them.

Inconsistent daily-activity statements are a frequent denial reason. Social media, part-time earnings, and optimistic comments to a workers compensation IME doctor can all appear in the disability file. Honesty with context beats a polished story that collapses under vocational expert questions.

Injured Workers

When should an injured New Jersey worker apply for SSDI?

Apply when a serious work injury or occupational disease is expected to keep you from substantial gainful activity for at least twelve months, or when a failed return-to-work attempt shows the restriction is lasting. You do not need to wait until the workers compensation case is fully settled, and waiting too long can shrink back benefits.

Light duty that is temporary, unreliable, or paid far below substantial gainful activity may still support a claim — facts matter. Carriers push early returns; SSA asks whether you can sustain competitive work. Those two questions are not the same. Document why a light-duty assignment failed: pain flares, attendance, lifting beyond restrictions, or an employer that withdrew accommodations.

Catastrophic injuries — traumatic brain injury, multi-level spine surgery, amputations, severe burns — often present clearer medical pictures. Mid-range orthopedic cases still succeed when the vocational profile is older age, limited education, and a history of heavy work. We evaluate age, education, and past work categories the same way hearing offices do.

Why This Firm

Why hire Kaplan & Kaplan for SSDI or SSI in New Jersey?

Disability claimants are flooded with national television firms that never set foot in a New Jersey compensation court. Kaplan & Kaplan is a North Haledon claimant firm that already litigates medical treatment, temporary disability, and permanency before Judges of Compensation. That local medical record is often stronger than a cold Social Security application built from blank forms.

Ken Kaplan, Esq. — New Jersey bar 1996, Super Lawyers 2024–2026, University of Connecticut and Nova Southeastern Law — represents injured people only. We do not promise approval. We do promise a candid assessment of whether the medical and vocational evidence can support a claim under current SSA rules.

If your only issue is a short-term injury with expected full recovery inside a year, SSDI may not fit. If your claim was denied for missing records, we may be able to rebuild the file. Call (973) 694-8100 and bring denial letters, workers compensation claim numbers, and a list of treating providers.

Denials

Why are so many New Jersey SSDI applications denied at first?

Initial denials are common nationwide, and New Jersey claimants are not exempt. Forms arrive incomplete, treating sources never respond, consultative exams contradict the treating record, and vocational reviewers assume a capacity that does not match real pain, attendance problems, or medication side effects. A denial letter is a decision to appeal — not a medical truth.

Reconsideration is still an agency-level review. It can succeed when new imaging, specialist notes, or clearer function evidence fills the gap. Many claimants still need an ALJ hearing. Hearing preparation includes reviewing the exhibit file, drafting a pre-hearing brief when useful, preparing your testimony, and anticipating vocational expert hypotheticals about sit-stand options and transferable skills.

If you already filed alone and were denied, bring the entire packet. We look for onset-date errors, ignored treating opinions, and work attempts that were unsuccessful. Fixing those issues early shortens the path more than filing a bare request for hearing and hoping the judge fills the blanks.

Next Steps

What should I gather before a disability consultation?

Collect SSA denial or award letters, your my Social Security printouts if available, workers compensation petition numbers, treating doctor names, medication lists, and a timeline of failed return-to-work attempts. Write down how a typical day actually works — not how you wish it worked. Note any part-time earnings and household income issues that affect SSI.

Then schedule a free consultation. We will tell you whether to file, appeal, wait for more medicine, or focus on the Division case first. We will also flag offset risks before any workers compensation settlement language is finalized.

If you are still treating in an authorized workers compensation chain, keep those appointments. SSA and the Division both punish unexplained gaps. If the carrier cut off care, tell us immediately — a Motion for Medical and Temporary Benefits on the compensation side can also strengthen the disability medical record.

Plain-language answers for injured workers and families in New Jersey.

Yes, but SSDI may be offset. The combined amount is subject to a federal cap. Settlement language and the type of workers compensation benefits affect the calculation, so review offset rules before signing a lump-sum agreement.
