Why a New Jersey car accident claim needs the full coverage map

Summary

A New Jersey car accident case recovers against at-fault drivers and, when needed, your own uninsured or underinsured motorist coverage. PIP often handles initial medical bills in personal crashes. Kaplan & Kaplan represents injured plaintiffs and workers only — never insurers. Free consultation. Call (973) 694-8100.

When the crash happens in the course of employment — deliveries, job-site travel, company cars, rides between worksites — workers compensation also opens. Treating those files as 'just PIP' leaves wage and permanency benefits on the table. Treating them as 'just comp' can leave pain-and-suffering unfiled against the other driver. The complete map is the point of this page.

Ken Kaplan, Esq. (NJ bar 1996; Super Lawyers 2024–2026; UConn and Nova Southeastern Law) builds overlap files from 810 Belmont Avenue Suite 201, North Haledon. Our firm has handled 1,000+ cases and recovered $24M+ for injured people. Prior results do not guarantee a similar outcome. Crash value turns on liability proof, injury documentation, and which policies actually apply.

Scenario: you are hit making a delivery. The other driver's carrier calls the same day. Your employer files an accident report. PIP paperwork arrives at home. Without a map, you answer the wrong questions to the wrong insurer and undercut both the liability case and the workers compensation file. Kaplan and Kaplan builds that map first.

Weekend personal crashes with no work connection are still injury matters we evaluate. The difference is simply which coverages open. Either way, documented medicine and careful statements beat tough-it-out culture.

Police reports, cameras, and airbag data get old. Call before the other carrier records your statement. This guide covers coverage stacks, work-related crashes, common mistakes, and how we help. Pair it with third-party claims and trucking delivery workers comp pages. For the civil hub, visit personal injury.

Coverages

What insurance coverages may apply after a New Jersey car crash?

Liability, PIP, UM/UIM, and — when the crash arose out of employment — workers compensation can all apply. The right combination depends on fault, policy language, and whether you were working when hit.

Coordination matters. Paying medical only through PIP when workers compensation should be primary for a work crash can create reimbursement and benefit gaps. We identify the primary medical path early and preserve civil claims for pain and suffering.

Commercial policies, rental agreements, and rideshare overlays add complexity. Declarations pages and the police report's vehicle information start that analysis. Do not assume the first adjuster who calls represents every available dollar.

Liability

The at-fault driver's bodily injury coverage pays when negligence is proven and policy limits allow.

PIP

Personal Injury Protection on many NJ auto policies pays medical expenses subject to your selected limits and rules.

Workers compensation

If the crash arose out of and in the course of employment, medical and wage benefits may open in the Division.

UM/UIM

Your uninsured or underinsured motorist coverage can apply when the at-fault driver has no or low limits.

On-the-Job Crashes

What if you were working when the car accident happened?

Course-of-employment crashes often support both a workers compensation claim and a civil claim against the other driver or company. Delivery, sales routes, and company-vehicle travel are classic examples.

Report the crash to your employer and document that you were on work duties. File or protect a claim petition deadline as well as the civil statute. See our trucking and delivery workers compensation page for driver-specific patterns and our third-party claims page for lien and exclusive-remedy basics.

Employers sometimes push you toward a 'company accident report only' process. That is not a substitute for Division benefits or a liability claim. Keep medical records clear that the crash occurred while working.

Passengers who are coworkers, helpers on a truck, or aides in a company van can have parallel claims. Identify every injured person early so evidence and witness statements are shared before memories fade.

After the Crash

What should you do after a New Jersey car accident?

Get medical care, document the scene, avoid recorded statements until you have advice, and calendar every insurance and court deadline. Early photos and witness names still win liability disputes years later.

Soft-tissue injuries and concussions are frequently minimized by carriers. Consistent treatment notes matter more than toughing it out. Gaps in care become their favorite argument.

If airbags deployed or you hit your head, seek evaluation for concussion even when you feel mostly fine. Delayed neurologic complaints are common, and carriers exploit gaps between the crash and the first chart note.

  • 1Seek medical evaluation even if adrenaline masks pain.
  • 2Photograph vehicles, skid marks, road conditions, and visible injuries.
  • 3Exchange information and ask for the police report number.
  • 4Do not give a recorded statement to the other carrier before talking to us.
  • 5Track missed work and out-of-pocket costs from day one.
  • 6Tell providers if the crash happened on the job.

Liability

What if you were partly at fault for the crash?

New Jersey comparative-fault rules can still allow recovery depending on percentages and facts. Partial fault is not an automatic zero — but statements that exaggerate your blame are costly.

Intersection cases, lane changes, and multi-vehicle pileups need careful reconstruction. Do not guess about speed or distance in adjuster calls. Let the evidence speak after we review the report and any available video.

Dashcam and doorbell video from nearby buildings disappear on short retention cycles. We send preservation letters quickly when a liability dispute is obvious from day one.

Our Role

How does Kaplan & Kaplan handle car accident claims?

We map every applicable coverage, preserve liability evidence, coordinate PIP and workers compensation medicine, and pursue civil damages — plaintiff-only from North Haledon with statewide reach.

We are not a volume crash mill that never files a claim petition, and we are not a comp-only office that ignores the liability policy. Free consultation at (973) 694-8100 or [email protected]. Related guides: personal injury hub, third-party claims, trucking delivery, and workers compensation.

From North Haledon we handle statewide crash intakes with the same claimant-and-plaintiff discipline we use in the Division: deadlines first, medicine second, negotiation third. Workers compensation fees follow Division rules; civil fees are explained before you sign.
