Do not confuse weekly healing checks with permanency value
Summary
Temporary disability benefits in New Jersey workers compensation are wage-replacement payments while you are healing and unable to earn full wages under the statute; permanent disability benefits address lasting impairment after you reach maximum medical improvement. Mixing those ideas is how claimants misunderstand both settlement talks and check stoppages. Kaplan & Kaplan represents injured New Jersey workers and plaintiffs only — never employers or insurers. Temporary total disability generally applies when you are out of work entirely due to the work injury. Temporary partial concepts can apply when restricted duty reduces earnings. Waiting periods and rate caps still apply.
Permanent partial disability is the common path after orthopedic injuries leave residual loss. Permanent total disability is a different, higher showing involving inability to work in a broader sense.
Carriers sometimes stop temporary checks by declaring MMI or offering light duty. Those moves may be legitimate or tactical. Compare them to treating notes before you assume the case is 'over.'

Think of temporary disability as the bridge while medicine tries to improve function, and permanency as the accounting for what remains when improvement plateaus. Crossing those ideas confuses settlement talks.
Some workers receive temporary benefits, return to work, then need additional surgery. Disability categories can recur. Keep reporting honest each time the medical status changes.
Carrier letters that say you are at MMI should be compared to the authorized treating doctor's last note. An IME stamp alone is not the end of temporary benefits analysis when surgery remains recommended.
While Healing
What are temporary disability benefits in New Jersey?
Temporary benefits replace a portion of wages when a compensable injury keeps you out of work or on restricted duty that cuts pay, subject to statutory formulas, waiting periods, and medical support from authorized providers.
Checks should track medical disability periods. Gaps without a return-to-work release or suitable light-duty offer deserve questions — and sometimes motions.
Average weekly wage calculations matter. Overtime and consistent earnings history can change the rate. Bring paystubs spanning the pre-injury period.
Light-duty offers that ignore written restrictions are not automatic permission to stop temporary total benefits. Document the mismatch.
Waiting periods and statutory maximums apply. Ask counsel to verify the rate on your stubs against wage evidence. Underpayments compound quietly over months.
If you are terminated while on temporary disability, do not assume benefits automatically continue or automatically end. The medical disability status and suitable work availability still drive analysis.
Document holiday and overtime patterns before the injury. Understated average weekly wage shrinks every temporary check and later permanency discussions that reference rates.
Hinge Point
Why does maximum medical improvement change the conversation?
MMI means further treatment is not expected to materially improve the condition — not that you feel perfect, and not that you must accept a low permanency offer the same week an IME stamps MMI.
You can be at MMI and still need palliative care. Whether that care remains open depends on order language and case posture.
Disputed MMI is common when treating surgeons want more therapy or surgery and the IME says you are done. Judges resolve those conflicts with evidence, not adjuster emails.
Do not sign permanency paperwork you do not understand just because temporary checks ended. Ending TTD and valuing permanency are related but distinct events.
Palliative care after MMI — injections, medications, bracing — may still be reasonable. MMI is not a synonym for 'no doctor visits ever again.'
After MMI
How do permanent partial and permanent total disability differ?
Permanent partial disability compensates lasting impairment that does not necessarily end all earning capacity; permanent total disability addresses situations where the worker cannot return to suitable employment given the injury and vocational factors.
Partial disability cases lean on medical impairment ratings, functional testimony, and sometimes schedules or body-part frameworks under New Jersey practice — always fact-specific.
Total disability cases need a deeper vocational and medical record. Do not self-label; get counsel to evaluate.
We do not publish invented settlement dollars. Your permanency discussion should be evidence-based in consultation, not driven by social-media rumors.
Combination injuries to spine, shoulder, and psyche require careful pleading and proof. Fragmented ratings that ignore combined functional impact understate disability.
If you cannot read, write, or speak English fluently, say so when permanency and vocational issues arise. Transferable skills assumptions fail when communication barriers are real.
Temporary
Wage replacement during healing / restricted duty periods.
Permanent partial
Lasting impairment with remaining work capacity possible.
Permanent total
Inability to return to suitable work on the full record.
Strategy
How should claimants plan across temporary and permanent phases?
Protect temporary benefits while healing, finish necessary treatment, document function honestly, then address permanency with complete records — coordinating any SSDI filing if long-term disability is realistic.
Kaplan & Kaplan guides claimants through both phases. Ken Kaplan, Esq. will not rush a permanency close that abandons needed care.
If light duty ends temporary checks improperly, call promptly. Months of silence are hard to reconstruct.
Free consults review your current benefit status and whether MMI has actually been reached on treating evidence.
Vocational rehabilitation conversations sometimes appear in severe cases. Participate thoughtfully and tell counsel before you sign plans that assume jobs you cannot sustain.
